Terms of service
1. Your agreement with us
Clients sign up through a service agreement, order or proposal with Better Inbound. If that agreement says something different from these terms, the agreement wins. Our privacy policy explains how we handle information and is part of these terms.
2. The service
Better Inbound brings a business’s leads, calls, messages, reviews, social media, ads and reporting into one place, with AI features that answer calls, follow up on leads and draft replies and content. Our team may set up and run parts of the service for you. Features can change as we improve the service; we’ll give notice before removing something you rely on.
3. Accounts and access
- Access is by invitation. Keep your sign-in secure and tell us right away if you think someone else has used your account.
- The client is responsible for who it invites and the roles it gives them, and for everything done under its account.
- You must be at least 18 and able to agree to these terms for your business.
4. Connected accounts
You can connect accounts you control, such as Google Analytics, Google Search Console, Google Calendar, Google Drive, your CRM, social pages and ad accounts. You authorize us to access and act on them only as needed to provide the features you use, and you can disconnect them at any time. Your use of those services stays subject to their own terms. Our use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements.
5. Your data
You own the content and data you or your customers put into Better Inbound. You give us permission to host, process and display it only to provide, secure and support the service for you. You confirm you have the rights and consents needed for the data you bring, including your customers’ contact details.
6. Calls, texts, emails and AI
- You are responsible for having consent to call, text or email your leads and customers, and for following the laws that apply to your marketing, such as telemarketing, anti-spam and call recording laws.
- AI features can make mistakes. Check drafts, posts and campaigns before approving them. Nothing is sent to your customers without a person’s review, except where you have switched on an automated feature such as the AI receptionist or lead follow-up calls.
- Keep your company profile, hours, services and “never say” rules up to date, since the AI relies on them.
7. Acceptable use
Don’t use Better Inbound to:
- break the law or anyone’s rights, or send spam, deceptive or harassing messages;
- upload malware, probe or overload the service, or get around its security or limits;
- access accounts or data you aren’t authorized to use; or
- copy, resell or reverse engineer the service, or use it to build a competing product.
We may suspend access that puts the service, other clients or the public at risk, and will tell you why when we can.
8. Fees
Fees, billing and ad spend are set out in your service agreement. Ad spend paid to advertising platforms is your responsibility unless agreed otherwise.
9. Our property
Better Inbound, including its software, design and content (but not your data), belongs to us and our licensors. We give you a limited, non-transferable right to use it while your account is active. If you send us feedback, we may use it without owing you anything.
10. Availability and disclaimers
We work to keep Better Inbound available and accurate, but the service is provided “as is”. We don’t guarantee it will be uninterrupted or error-free, or any particular marketing result such as leads, rankings or bookings. Third-party services you connect can change or stop working, and we aren’t responsible for them.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or lost profits or revenue. Our total liability for any claim about the service is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law.
12. Indemnity
You’ll defend and compensate us for claims arising from your data, your marketing to your customers (including consent to calls and texts), or your breach of these terms.
13. Ending the service
Either party can end the service as set out in your service agreement. When it ends, your access stops, connected accounts are disconnected, and we delete your data within 30 days unless you ask for an export first or the law requires us to keep it.
14. Governing law
These terms are governed by the law named in your service agreement. If none is named, they are governed by the law of the place where Better Inbound’s operating company is registered, and disputes go to the courts there.
15. Changes to these terms
We may update these terms. We’ll post the new version here with a new date and tell clients about material changes in advance. Continuing to use the service after a change takes effect means you accept it.
